Probate

Estate administration, also called probate, is the legal process that occurs after a person has passed away. The deceased person’s will is validated by the court and their assets are distributed accordingly. In the event that the deceased passed without leaving a will, a petition is filed with the court for letters of administration. Our experienced team can guide you through this often complicated and emotional process including:

  • Filing the last will and testament or petition for letters of administration with the probate court
  • Requesting the court to start the probate process
  • Identifying the estate’s assets
  • Advising the Executor or Administrator on the process of paying the deceased’s debts
  • Assisting with the proper distribution and transfer of decedent’s assets

Selling and buying probate real estate in Georgia typically takes 6-12 months because the property will be subjected to probate proceedings. The probate process includes property appraisal, title exams, and review of deed recordings. Anyone can purchase probate property with the court’s approval.
